New UN Telecom Regulations Set to be Introduced at 2012 Conference

The International Telecommunication Union (ITU) is a UN agency whose sole objective is to focus on the ICT and telecommunications industries. The ITU is over 100 years old and claims that it is: 'the sovereign right of each state to regulate its telecommunications', as such refusing any authority to regulate domestic communications.

Over 100 years ago the International Telecommunication Union was formed by the 'league of nations' (the predecessor to the united nations) with the sole purpose of focusing on the ever expanding ICT and telecommunications industries, ensuring that the regulations were kept in line with the advancement of associated technologies.

Although ITU regulations do not carry the weight of the law, per se, they set out detailed regulation suggestions and requirements for all national level regulatory authorities, and address a wide range of topics including standardisation and economic and technical issues.

The conference is scheduled to take place later this year in Dubai, where one of the highlights will be the renegotiation of a treaty called the International Telecommunication Regulations (ITRs), made over 20 years ago in 1988.

The ITRs was instrumental in providing a framework of governing principles concerned with international telecommunication transport and services along with the interconnection of telecommunications facilities. The ITRs also provided the guidelines for mutual and private agreements between countries and non-governmental organisations respectively.

An overhaul of the ITRs has long been on the cards, and although any alterations made will not become law, it is widely acknowledged that any decisions made at the conference will play a big part in the way internet and telecommunications are regulated internationally over the coming years.

Whatever changes are deemed fit to be introduced, and however much opposition there may be towards them, the telecoms industry can count itself lucky that it has been able to avoid a re-assessment of its' guidelines for so long. Ever since fifty US states were pre-empted from regulating Vonage by the Federal Communications Commission (FCC) back in 2004, the entire Voip industry has been biding its time in the knowledge that at some point the regulations would have to be changed.

And change they have. Regulations have been creeping in at an ever increasing rate over the past few years, with 2012 set to be the most active regulatory year yet; prompting fears that the industry will soon become as heavily regulated as that of the traditional telephone service.

Ever since the 'interconnected Voip service' regulations were introduced, any provider offering this service has been hit with a plethora of FCC regulatory requirements. And now, just a few years later, two-way Voice Over Internet Protocol service providers are faced with a set of regulations almost as severe as standard telephone services.

In 2012 the US Congress further signalled their intentions to codify the contribution duties of interconnected as well as non-interconnected Voip providers with the introduction of the '21st Century Video and Communications Act'.

The term 'Interconnected Voip Service' was originally defined by the FCC in 2004 in three main parts; (a) it requires a broadband connection from the users' location, (b) it enables real-time, two-way voice communications, and (c) it requires internet protocol-compatible customer premises equipment.

In the years since this definition, the FCC has been debating whether it should be updated to allow for changes in technology, such as specifying an 'internet connection' as opposed to a 'broadband connection' and 'connectivity' as the ability to connect calls to U.S. E.164 numbers instead of PSTN.

Google Decides Against Including Voip

The world beating behemoth that is Google has shocked many with the news that its new super high speed television and internet network service known as Google Fiber will not include a Voip service.

Google Fiber has just been released as a test market in Kansas city, where the service has been hugely well received. Fiber offers unrivaled downloading speeds and capabilities, with speeds of roughly three times that of standard broadband connections.

It seems that the main reason for the decision is to do with the difficulties of combining voice and data into a single connection - as would be required in order to transmit the Voip signal - along with the problems surrounding the different communication legislation's across various states.

The regulations pose a serious headache for service providers looking to provide an all inclusive service, due to the way that tax state calculations are determined across different states. But it would seem that had Google wanted to find a solution, they could have.

It is still possible for Google Fiber subscribers to make use of Voip services by purchasing of a MagicJack or Ooma and registering for their own low cost service, however, this solution could prove problematic for certain customers, as Dave Greenbaum of GigaOM points out.

But this solution is far from the best option for the majority of consumers, as GigaOM's David Greenbaum points out: "Many people still use alarm or fax systems that need a landline, and although both can be done over the internet, it is an additional hassle to switch".

It seems clear that Google could have resolved this issue if they had so wished, but decided against it - obviously believing that a lack of voice service will not have a detrimental effect on the service's popularity. Whether they will end up regretting this decision, only time will tell.

But even if they have made a mistake and under-estimated the demand for an inclusive Voip service, you can guarantee that they will put it right next time.
